Turner & Townsend was appointed to prepare Expert Reports in relation to a claim of US$43m for variations (measurement and value), constructive acceleration and disruption on the new Terminal Building and airport infrastructure at Astana airport in Kazakhstan.
International Arbitration proceedings were commenced to resolve the contractor's claims.
The client required expert reports concerning the valuation principles used to value to the clients claim and expert opinion on the value of the claimed items.

The Turner & Townsend team lead by an experienced quantum expert reviewed the FIDIC based contract and measurement rules under the contract to establish the correct pricing methodology for the variations.
The expert, assisted by the team produced preliminary reports on the 10 largest value issues and a report on general measurement principles under the contract and established general trends with the variation account to enable the variations to be grouped together and dealt with by principle.

Turner & Townsend assisted the legal team in identifying the commercial principles used in valuing the account an identifying the largest variation items on which to focus the approach.
Addressing the largest value issues gave lawyers assurance in addressing the claims as a whole, ultimately leading to settlement.
Turner & Townsend also identified those areas of the case where the position on entitlement was not strong and could potential damage the ability to recover all amounts claimed.
